Failure to comply

It is a legal requirement that should your company become obligated under the packaging regulations that they register with the relevant environment agency.

You must be registered by 7th April each year. Failure to do so is an offence and you will be open to prosecution.
In 2010 the Environment Agency introduced Civil Sanctions, which allow civil penalties to be issued rather than take criminal court cases for lesser offences. Enforcement Undertakings (EU) are a Civil Sanction used for Packaging Regulations offences. The environmental agencies have the power to apply civil penalties for certain offences including failure to register. An EU allows the offending company to restore and remediate any environmental damage they have caused.
